Terms of Service

MyBday Star ("we," "us," "our") is an online service that creates personalized birthday invitation bundles using artificial intelligence. By using MyBday Star, you are entering into a binding agreement with us.

MyBday Star generates custom digital birthday bundles, which may include:

• An animated video invitation
• 16 printable products (invitation cards, banners, toppers, stickers, and more)
• A digital invitation
• Character stickers
• A phone wallpaper
• An RSVP page (included in all bundles)

All products are digital. Nothing physical is shipped.

To access your bundle after purchase, you must sign in. Signing in automatically creates your account — no separate registration is needed. You are responsible for maintaining the confidentiality of your account credentials. You must be at least 18 years old to use our service.

Before payment, you will see a preview of your child's character. By completing payment, you confirm that you have reviewed the preview and are satisfied with the result. You agree that the final bundle will be consistent with the approved preview.

Our bundles are priced as shown on the Pricing page. Prices may change at any time, but changes will not affect orders already placed.

All sales are final. Our products are custom digital items generated specifically for your child upon payment. Because the product is created and delivered immediately, we do not offer refunds once the bundle has been generated.

If you experience a technical issue — such as a corrupted file or incorrect text — please contact us at support@mybdaystar.com and we will resolve it at no charge.

Free correction: If you made a typo in the party details (name, date, location), you may correct them for free in your Dashboard. Your printables will be regenerated automatically.

Video regeneration: If you wish to regenerate the video with corrected details, a fee of $3.99 applies, as video generation requires significant AI processing.

By uploading a photo, you confirm:

• You are the parent or legal guardian of the child in the photo, or you have explicit permission from the parent or guardian to upload it
• The photo does not include any other person whose consent has not been obtained
• You grant us a limited, temporary license to use the photo solely to generate your bundle

Your child's photo is used only during the creation process and is deleted from our systems immediately after your bundle is generated. It is never stored, shared, or used for any other purpose.

Our bundles are created using artificial intelligence. The character illustration is an artistic interpretation based on your child's photo. We do not guarantee an exact likeness. You had the opportunity to review and approve a preview before payment. The final result will be consistent with that preview.

We are not responsible for results that differ from your expectations if the preview was reviewed and approved.

The AI-generated character illustration is an artistic rendering and does not constitute a biometric identifier or facial template. No biometric data is extracted, stored, or processed at any point.

Your bundle files are available for download in your Dashboard for 30 days after your party date. After this period, files are automatically deleted from our servers. We recommend downloading all files before your party date.

We are not responsible for files that are unavailable after the 30-day period.

All bundles include an RSVP page. Guest information submitted through the RSVP page (name, attendance status, guest count) is stored temporarily and deleted along with your bundle files 30 days after your party date.

All content on MyBday Star — including design, code, graphics, and character templates — is owned by us and protected by intellectual property law. Your personalized bundle is licensed to you for personal, non-commercial use only. You may not resell, redistribute, or commercially exploit any part of your bundle.

You agree not to:

• Use our service for any unlawful purpose
• Upload photos of minors without parental consent
• Upload offensive, abusive, or inappropriate content
• Attempt to reverse-engineer, copy, or scrape our service
• Misrepresent your identity or impersonate others
• Upload images of minors without being their parent or legal guardian. Any such attempt is a material breach of these Terms and may be reported to relevant authorities.

We reserve the right to refuse service to anyone at any time.

The RSVP feature is provided as a convenience tool only. We do not verify the accuracy of any guest information submitted through the RSVP page.

By using the RSVP feature, you confirm that you have obtained permission to provide any names or personal information entered on behalf of others.

You are solely responsible for:

• Any information you or your guests enter through the RSVP page
• Any content you share externally through messaging apps, email, or any other platform
• How recipients use or further distribute any shared links or content

We are not responsible for how shared links, content, or guest information are used once distributed outside our platform. We do not guarantee that RSVP responses reflect actual attendance. The RSVP feature is intended for informal use only.

Our service allows you to share content externally, including video invitations, printables, and RSVP links. Any sharing of content is done at your own discretion and risk.

We do not control how recipients use or further distribute shared content, and we are not responsible for any consequences resulting from such sharing.

By sharing content outside our platform, you confirm that you have the right to share it and that doing so complies with applicable laws.

Our service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that the results will meet your specific expectations.

To the maximum extent permitted by law, our total liability to you for any claim arising from your use of MyBday Star is limited to the amount you paid for the specific bundle giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages of any kind. We are not responsible for how users interact with content shared outside our platform, including RSVP pages and downloadable files.

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of our service, your violation of these Terms, or your violation of any third-party rights.

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Informal Resolution First
If you have a dispute with us, please contact us first at support@mybdaystar.com. Most issues can be resolved quickly and informally.

Binding Arbitration
If we cannot resolve a dispute informally within 30 days, you and we agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of MyBday Star will be resolved exclusively by binding arbitration — not in court. This means you waive your right to a trial before a judge or jury.

Arbitration will be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA) Consumer Arbitration Rules, which are available at www.adr.org. The arbitration may be conducted by telephone, video call, or written submissions, so you will not need to travel.

The arbitrator may award the same relief that a court could award, on an individual basis only.

Class Action Waiver
YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

If a court finds this class action waiver unenforceable, then the arbitration agreement in this section will be null and void, and disputes will be resolved in court subject to the governing law below.

Exception
Either party may bring an individual claim in small claims court if the claim qualifies.

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute not subject to arbitration will be resolved exclusively in the state or federal courts located in Delaware, and both parties consent to personal jurisdiction there.

We may update these Terms at any time. We will post the updated Terms with a new "Last Updated" date. Continued use of our service after changes are posted constitutes your acceptance of the new Terms.
