Terms of Service

MyBday Star is an online service operated by Nofer AI. If you use our website or purchase a bundle, these Terms apply to you.

MyBday Star creates personalized digital birthday bundles for families. Depending on the bundle purchased, an order may include digital invitations, printable party items, stickers, wallpapers, RSVP pages, and video invitations.

All products are digital. Nothing physical is shipped.

You must be at least 18 years old to use MyBday Star.

To access purchased bundle files, you may be required to create an account or sign in. You are responsible for maintaining the confidentiality of your account credentials and for activity that occurs under your account.

Before payment, you will be shown a preview of your child's personalized illustrated character. By completing payment, you confirm that you reviewed and approved that preview.

Your final bundle will be created based on:

• the approved preview, and
• the party details and other information you provide during the order process.

Because the bundle is personalized and may include creative or automated generation elements, the final bundle may include minor variations in layout, wording, formatting, or generated assets. However, the core illustrated child character will remain materially consistent with the approved preview.

The preview is intended to show the character style and design you are approving before purchase. It is not a frame-by-frame or file-by-file preview of every final bundle asset.

Prices are shown on the website at the time of purchase and may change at any time for future orders.

Payments are processed by third-party payment providers. By completing a purchase, you also agree to the terms and policies of the payment provider used for your transaction.

Order issues and refund eligibility are governed by our Refund Policy. If you experience an issue with your order, please contact us at support@mybdaystar.com and we will review the issue and try to resolve it.

By uploading a photo to MyBday Star, you represent and warrant that:

• you are the parent or legal guardian of the child shown in the photo, or
• you have explicit authorization from the child's parent or legal guardian to upload the photo and use it for this service.

You are solely responsible for ensuring that you have the right and permission to upload and use the photo for the ordered bundle.

You also represent and warrant that:

• the uploaded photo does not violate any law or third-party rights, and
• the information you provide to us in connection with the order is accurate to the best of your knowledge.

You grant MyBday Star a limited, non-exclusive license to use the uploaded photo solely as necessary to create and deliver your personalized bundle, including processing the photo through our automated generation and photo suitability review systems for this service.

Uploaded photos are not used for a public gallery, public avatar platform, or general-purpose face-editing service. Uploaded photos are deleted after bundle generation is complete and are not retained in our database or long-term file storage, subject to temporary processing, security, backup, or technical retention reasonably necessary to operate the service.

Your bundle is a personalized digital product created based on the photo, selections, and information you provide.

The character illustration and bundle materials are custom creative outputs and are not intended to be an exact photographic reproduction of the uploaded photo. By completing your purchase after preview approval, you acknowledge and accept the stylized and personalized nature of the final result.

Bundle files will generally remain available in your Dashboard for 14 days after your party date, unless otherwise stated on the website.

After that period, files may be removed from our systems. It is your responsibility to download and save your bundle files before the stated availability period ends.

Some bundles include an RSVP page. This feature is provided as a convenience tool for informal event responses only.

You are responsible for how you share your RSVP link and for the party information you choose to include in it. We do not guarantee attendance accuracy, guest participation, or the completeness of RSVP submissions.

Your personalized bundle is licensed to you for personal, non-commercial use only. You may use it for your own birthday celebration and related personal purposes.

You may not resell, sublicense, redistribute, commercially exploit, or offer any MyBday Star bundle materials, templates, or generated outputs as a product or service to others.

You agree not to:

• use the service for any unlawful purpose;
• upload content you do not have permission to use;
• upload offensive, abusive, infringing, or inappropriate content;
• upload a child's photo without the required permission;
• interfere with, scrape, copy, reverse-engineer, or misuse the service or website;
• attempt to access another customer's account, files, or bundle materials.

We may refuse service, suspend access, cancel an order, or remove content if we reasonably believe these Terms have been violated or that use of the service presents legal, security, or abuse risks.

All website content, branding, design elements, software, templates, graphics, and other non-user materials made available through MyBday Star are owned by us or our licensors and are protected by applicable intellectual property laws.

Except for the limited personal-use license expressly granted in these Terms, no rights in MyBday Star intellectual property are transferred to you.

MyBday Star is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we do not guarantee uninterrupted service, error-free operation, or that every bundle will satisfy every personal preference or expectation.

To the maximum extent permitted by law, MyBday Star's total liability to you for any claim arising out of or relating to the service or your order will not exceed the amount you paid for the specific order giving rise to the claim.

To the maximum extent permitted by law, MyBday Star and Nofer AI will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, loss of data, loss of business opportunity, or damages arising from links or files shared by you outside the platform.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded under applicable law.

To the maximum extent permitted by law, you agree to indemnify and hold harmless MyBday Star and Nofer AI from claims, losses, liabilities, and expenses arising out of:

• your uploaded content,
• your breach of these Terms,
• your misuse of the service, or
• your violation of applicable law or third-party rights.

If you have a dispute or concern about an order, please contact us first at support@mybdaystar.com and provide a brief written description of the issue. We will attempt in good faith to resolve the matter informally before either side starts formal legal proceedings.

To the maximum extent permitted by applicable law, any claim or dispute arising out of or relating to MyBday Star, these Terms, or your order must be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective, coordinated, consolidated, representative, or similar proceeding.

To the maximum extent permitted by applicable law, you and MyBday Star each waive any right to participate in a class action, class arbitration, representative action, private attorney general action, or other proceeding in which a person acts in a representative capacity.

If any portion of this Section 17 is found unenforceable as to a particular claim or remedy, the remaining portions of this Section 17 and the rest of these Terms will remain in effect to the fullest extent permitted by law.

These Terms are governed by the laws of the State of Israel, without regard to conflict-of-law principles, except to the extent applicable consumer protection law requires otherwise.

If a dispute is not resolved informally and proceeds in court, you agree that the courts located in Tel Aviv, Israel will have exclusive jurisdiction, except where applicable law does not permit this provision to be enforced.

We may update these Terms from time to time. If we do, we will post the updated version on this page with a new "Last Updated" date. Continued use of MyBday Star after updated Terms are posted means you accept the revised Terms.
